of the AMREP FITNESS online store
Seller and basic terms
I. Introductory provisions
1. Seller
The operator of the AMREP FITNESS online store and the seller is:
Fit - B, s.r.o.
E. M. Šoltésovej 3109/1
052 01 Spišská Nová Ves
Slovak Republic
Company ID (IČO): 47 582 995
Tax ID (DIČ): 2023966296
VAT ID (IČ DPH): SK2023966296
The company is registered in the Commercial Register of the Municipal Court Košice, Section Sro, File No. 34677/V.
E-mail: info@amrepfitness.eu
Phone: +421 908 024 911
Web: www.amrepfitness.eu
(hereinafter the "Seller" or "AMREP FITNESS").
2. Buyer
The Buyer is any natural or legal person who concludes a purchase or other contract with the Seller. For the purposes of these Terms and Conditions we distinguish between:
- a Consumer - a natural person who, when concluding and performing the contract, does not act within the scope of their business, employment or profession;
- a Business Buyer - a person who concludes the contract in connection with their business or professional activity.
Providing a company ID is an important indication of a business purchase, but it is not the only criterion. What matters is the nature and purpose of the specific transaction.
3. Subject of these Terms
These Terms and Conditions govern the rights and obligations arising in particular from the purchase of goods and the ordering of related services through the online store www.amrepfitness.eu. The Terms and Conditions form an integral part of the contract.
If the Seller and the Buyer have individually agreed on a condition different from these Terms, the individual agreement prevails.
For complex B2B gym fit-outs, custom manufacturing, individual price quotations or projects, the contractual relationship may be governed by a separate contract or a confirmed quotation.
Goods and their characteristics
II. Goods, their characteristics and intended use
1. Product information
The Seller states the main characteristics, technical parameters, price and other information needed for the purchase decision with each product. The goods must correspond to the characteristics and requirements agreed in the contract and to the objective requirements laid down by law.
Photographs and visualisations may be illustrative, in particular as regards the depiction of colours, surroundings or immaterial details. This provision does not, however, allow the Seller to deliver a product that does not correspond to the agreed type, dimensions, function, quality or other essential characteristics.
2. Manufacturing tolerances
For products where this is customary given the manufacturing method, reasonable manufacturing tolerances may exist, for example in dimensions, weight, surface finish or shade. Such a tolerance must not result in the product failing to meet the agreed or legally required characteristics.
3. Intended use of fitness equipment
For selected products, AMREP FITNESS may state the intended use, for example:
- home use,
- light commercial use,
- full commercial/professional use.
The Buyer must use the product in accordance with its intended use, the user manual, safety instructions and maintenance requirements. Using the product in an environment or at an intensity for which it was not intended may be relevant when assessing whether a particular failure constitutes a defect of the product or damage caused by its improper use. This provision does not limit the Consumer's statutory rights.
4. Goods with digital elements
If the product includes digital content or a digital service necessary for its functionality, the relevant statutory provisions on goods with digital elements also apply to such a product. If updates are needed to keep the product in conformity, the Seller or the relevant provider will supply them to the extent required by law.
Prices and discounts
III. Prices and discounts
1. Price of goods
Prices addressed to Consumers are stated inclusive of VAT and all other taxes. Before submitting the order, the Buyer is shown the total price of the order including taxes, the selected delivery method and all other charges that can be determined in advance.
If a certain cost cannot reasonably be calculated in advance given the nature of the order, the Seller informs the Buyer before the conclusion of the contract of the way it will be calculated, or of the fact that such a cost may arise.
2. Discounts
When the Seller announces a price reduction, it states the previous price in accordance with the applicable legislation. For a standard discount announcement, this is generally the lowest price at which the Seller sold the goods during the 30 days preceding the price reduction.
3. Personalised pricing
If the price for a specific Consumer were individually adjusted on the basis of automated decision-making, the Consumer will be informed of this fact before submitting the order, to the extent required by law.
4. Obvious pricing error
The Seller takes reasonable measures to ensure that prices are correct. However, if an obvious technical or administrative error occurs - for example, a product worth thousands of euros being listed at a price of a few euros - the Seller is not automatically obliged to deliver the goods at such an evidently erroneous price.
The Seller will notify the Buyer of the error without delay and offer to conclude the contract at the correct price. If the Buyer does not accept the correct price, the order will be cancelled and all payments already received will be refunded without undue delay.
Order and conclusion of the contract
IV. Order and conclusion of the contract
1. Placing an order
The Buyer selects the goods, quantity, available additional services, delivery method and payment method. Before submitting the order, the Buyer can review and correct the entered data. The Buyer must provide true, correct and complete information.
2. Obligation to pay
If the order entails an obligation to pay, the button or similar function by which the Consumer submits the order is labelled "Order with an obligation to pay" or with other equally unambiguous wording. If this legal requirement were not met, the Consumer would not be bound by the order so submitted.
3. Receipt of the order
Immediately after receiving the order, the Seller electronically confirms its receipt to the Buyer. The automatic acknowledgement of receipt does not in itself constitute acceptance of the offer to conclude a contract, unless its content expressly states otherwise.
4. Conclusion of the contract
The purchase contract is concluded at the moment the Buyer receives the Seller's confirmation showing that the Seller accepts the order.
5. Inability to fulfil the order
If the Seller cannot fulfil the order to the extent ordered, for example because a product is unavailable, it contacts the Buyer and may propose a change. The changed offer binds the Buyer only after its acceptance. The Seller cannot unilaterally replace the ordered goods with other goods without the Buyer's consent.
6. Confirmation of the contract
The Consumer will receive confirmation of the contract on a durable medium, to the extent required by law, at the latest upon delivery of the product or the start of the provision of the service. Together with the order confirmation or in a follow-up e-mail, AMREP FITNESS provides the current Terms and Conditions and information on the right of withdrawal in a way the customer can store and later reproduce.
7. Language of the contract and its storage
In the English language version of the online store, the contract is concluded in English. The Seller stores the contract in electronic form. The Buyer receives its confirmation by e-mail and may request a copy at info@amrepfitness.eu.
V. Availability of goods
Information such as "in stock", "to order", "pre-order" or an estimated dispatch date reflects the current status according to the information available to the Seller. If a specific binding delivery date is stated with a product, the Seller is bound by that date.
A product marked "to order" or ordered from a supplier is not, for that reason alone, custom-made goods, and the Consumer does not automatically lose the right of withdrawal.
Payment and invoicing
VI. Payment terms
The Buyer may use the payment methods currently displayed in the online store at checkout. These may include in particular:
- online payment by card or another electronic payment method,
- bank transfer,
- cash on delivery, if available for the order,
- payment on personal collection, if this option is available.
For bank transfers, payment is made when the relevant amount is credited to the Seller's account.
For orders requiring individual manufacturing, special procurement of the product, or for individual B2B orders, advance payment or a deposit may be agreed. The Consumer must be informed of such an obligation before the conclusion of the contract.
No paid additional service may be added for the Consumer without the Consumer's express consent.
VII. Invoicing
The Seller issues the Buyer with the relevant accounting and tax document. The invoice may be delivered electronically to the Buyer's e-mail address or made available in the customer account.
Delivery of goods
VIII. Delivery of goods
1. Delivery methods
The current delivery methods and prices are stated in the online store. Depending on the type of goods, the order may be delivered in particular:
- by parcel courier service,
- via a pick-up point or parcel locker,
- by pallet transport,
- by freight or specialised transport,
- by personal collection.
2. Delivery time
Unless a different period has been agreed between the Seller and the Consumer, the Seller delivers the goods without undue delay, at the latest within 30 days of the conclusion of the contract.
If the Seller fails to deliver the goods within the agreed period, the statutory rules apply, including the Consumer's option to grant a reasonable additional period and subsequently withdraw from the contract. In the cases provided for by law, the Consumer may withdraw even without granting an additional period.
3. Pallet and oversized goods
Heavy or bulky fitness equipment - in particular strength machines, large weight sets, racks, rigs, flooring systems or similar goods - may be delivered by pallet or specialised transport.
Unless expressly stated otherwise for the specific service, standard pallet delivery does not include carrying the goods in, moving them indoors, assembly, anchoring or packaging disposal. The Buyer must ensure reasonable access to the unloading point. The exact scope of the delivery service is governed by the information stated with the selected delivery method or by individual agreement.
4. Assembly
If the Buyer orders assembly as a separate or additional service, the scope of the assembly and its price are stated with the service or in an individual quotation. If assembly or installation is part of the delivery under the contract, the relevant statutory rules on the correctness of assembly and the moment of delivery also apply to a consumer purchase.
5. Checking the shipment
We recommend that the Buyer check the condition of the packaging and the shipment upon receipt. If the packaging or the goods are visibly damaged, we recommend taking photographs, reporting the damage to the carrier and contacting AMREP FITNESS without delay at info@amrepfitness.eu.
If the Consumer does not report the damage to the carrier upon receipt, they do not automatically lose their statutory rights against the Seller.
IX. Transfer of ownership and risk of damage
In a consumer purchase, ownership of the sold item and the risk of accidental destruction, accidental deterioration and loss of the item pass to the Buyer at the moment of delivery in accordance with the applicable law.
X. Failure to accept the shipment
The Buyer must provide the cooperation reasonably needed for the delivery of the order. If the Buyer causes an unsuccessful delivery without a legitimate reason and the Seller demonstrably incurs additional costs as a result, the Seller may claim compensation to the extent permitted by law.
Merely failing to accept the shipment is not considered a proper notice of withdrawal from the contract. If the Consumer wishes to withdraw from the contract, they must communicate their decision unambiguously.
Withdrawal from the contract within 14 days
XI. Consumer's withdrawal from the contract without giving a reason
This section applies to Consumers only.
1. Withdrawal period
In the case of a distance contract, the Consumer may generally withdraw from the contract without giving any reason within 14 days. For the purchase of goods, the period starts:
- upon receipt of the goods,
- where several goods ordered together are delivered separately, upon receipt of the last goods delivered,
- for goods consisting of several lots or pieces, upon receipt of the last lot or piece,
- for regular delivery of goods over a defined period, upon receipt of the first goods.
The Consumer may withdraw from the contract even before this period starts to run.
For a separate distance contract for the provision of a service, the 14-day withdrawal period runs from the day the contract is concluded. The conditions for starting the service during this period and the possible loss of the right of withdrawal are governed by Article XIX.
2. Partial withdrawal
If the order contains several separate products, the Consumer may withdraw in respect of only some of them, if the nature of the contract allows it.
3. Extension of the period where information duties are not fulfilled
If the Seller fails to properly provide the Consumer with the legally required information on the right of withdrawal, the period may be extended in the manner provided by law, including an extension of up to 12 months.
XII. How to withdraw from the contract
The Consumer may withdraw by an unambiguous statement making clear that they wish to terminate the contract. The withdrawal may be sent, for example:
- by e-mail: info@amrepfitness.eu
- or in writing to: Fit - B, s.r.o., E. M. Šoltésovej 3109/1, 052 01 Spišská Nová Ves, Slovak Republic
The Consumer may also use the model form provided at the end of these Terms and Conditions, but its use is not obligatory. The deadline is met if the Consumer sends the notice of withdrawal no later than on the last day of the relevant period.
XIII. Online withdrawal from the contract
AMREP FITNESS ensures that, for a contract concluded through the online interface, the Consumer can also use an online withdrawal function. The function is labelled "Withdraw from the contract here" or similarly and is clearly and easily accessible throughout the withdrawal period.
The online function allows the Consumer to provide the details needed to identify the contract, in particular their name, order identification and e-mail address or other electronic contact. The Consumer confirms the withdrawal with a button labelled "Confirm withdrawal from the contract" or similarly.
After it is submitted, the Seller promptly sends the Consumer, on a durable medium, a confirmation containing the notice of withdrawal and the date and time of its submission.
The function is available at www.amrepfitness.eu/withdrawal-from-contract.
XIV. Returning the goods after withdrawal
The Consumer must send the goods back or hand them over to the Seller no later than 14 days after withdrawing from the contract, unless the Seller offers to collect them itself or through a person designated by it. The goods are returned to the Seller's warehouse address: Fit - B, s.r.o., Tehelná 20, 052 01 Spišská Nová Ves, Slovak Republic. The deadline is met if the goods are dispatched no later than on the last day of this period.
We recommend packing the goods in a manner appropriate to their nature so that they are not damaged in transit. The original packaging is not a condition of a valid withdrawal. However, the Consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
We recommend not sending the shipment cash on delivery. The Seller's refusal of a cash-on-delivery shipment does not in itself affect a withdrawal that has already been properly exercised.
XV. Costs of returning the goods
Upon withdrawal from the contract, the Consumer bears the direct costs of returning the goods, unless the Seller has stated that it will bear them itself.
For goods which by their nature cannot normally be returned by post - for example heavy machines or pallet shipments - the return transport may be considerably more expensive. For such goods, the Seller informs the Consumer of the estimated costs of return before the conclusion of the contract, to the extent required by law; for pallet shipments, a reasonable estimate of the return costs is EUR 70 to 150 per pallet (up to 900 kg).
If the Seller fails to fulfil the relevant legal information duty regarding the costs of return, the Consumer does not bear those costs.
XVI. Refund of payments
After a valid withdrawal, the Seller refunds the Consumer all payments received under the contract, including the costs of standard delivery, no later than 14 days after receiving the notice of withdrawal.
If the Consumer chose a delivery method more expensive than the least expensive common method offered by the Seller, the Seller is not obliged to refund the difference in delivery cost.
For a contract for the delivery of goods, the Seller is not obliged to refund the payments before it receives the returned goods or the Consumer proves that they have been dispatched, whichever occurs first, unless the Seller has offered to collect the goods itself.
The payment will be refunded using the same means of payment as the Consumer used, unless the parties agree on another method that does not incur any additional costs for the Consumer.
XVII. Trying out the goods and diminished value
The Consumer may examine and try out the goods only to the extent necessary to establish their nature, characteristics and functioning.
For fitness equipment, handling beyond the necessary extent may include, for example, prolonged training use, significant mechanical damage, scratches, soiling, damage to upholstery, removal of components or other interventions that are not needed for a normal check of the product's characteristics.
In such a case, the Consumer is liable only for the actual diminution in the product's value, not automatically for its entire price.
The Consumer is not liable for any diminished value of the goods if the Seller failed to fulfil its statutory information duty regarding the right of withdrawal.
XVIII. Exceptions to the right of withdrawal
The Consumer does not have the right to withdraw from the contract in the cases provided for by law. For the AMREP FITNESS product range, the most relevant exception is a contract for the supply of goods made to the Consumer's specifications or clearly personalised goods.
This may include, for example, genuinely custom-made equipment, a product with individual dimensions or other customer-specified modifications, or material cut to a specific individual size, provided that the statutory conditions are met.
A product cannot automatically be considered custom-made merely because it was not in stock and AMREP FITNESS ordered it from a supplier after the order was placed. Other statutory exceptions apply depending on the nature of the specific product or service.
XIX. Assembly and services during the 14-day period
If the Consumer orders a service, for example paid assembly, and requests that its provision begin before the expiry of the withdrawal period, the Seller obtains the Consumer's express consent required by law and provides the relevant information before starting the service.
If the Consumer subsequently withdraws before the service has been fully provided, they may be obliged to pay a proportionate price for the performance actually provided up to the moment of withdrawal, provided the statutory conditions are met.
After the service has been fully provided, the Consumer loses the right to withdraw from that service only if its provision began with their prior express consent and they were duly informed that they would lose the right of withdrawal upon full provision of the service.
Complaints and liability for defects
XX. Statutory liability for defects - Consumer
These Terms are governed by Slovak law. If you are a Consumer with habitual residence in another country, you additionally retain any more favourable rights granted to you by the mandatory consumer protection rules of your country of residence (see Article XXXIX).
1. Basic rule
The Seller is liable to the Consumer for any defect that the sold item had at the time of delivery and that becomes apparent within two years of delivery. For second-hand items, a shorter period may be agreed, but not shorter than one year.
2. Extension after the first repair
If a defect is remedied for the first time by repairing the item, the Seller's liability period is extended by 12 months. The extension occurs only once, regardless of the number of subsequent repairs.
3. Presumption of defect
If a defect becomes apparent during the statutory liability period, the item is presumed to have been defective at the time of delivery, unless the contrary is proven or unless this presumption is incompatible with the nature of the item or the defect.
4. Assembly
The Seller is also liable for a defect caused by incorrect assembly or installation if the assembly was part of the purchase contract and was carried out by the Seller or under its responsibility, or if the Buyer carried out the assembly incorrectly due to shortcomings in the instructions supplied by the Seller or the relevant provider.
XXI. When a defect must be notified
The Consumer may exercise rights arising from liability for defects only if they notify the defect within two months of discovering it, and no later than before the expiry of the relevant liability period. If the mandatory rules of your country of residence are more favourable to you in this respect, they remain unaffected.
XXII. How to make a complaint
The Consumer may notify a defect in particular:
- by e-mail: info@amrepfitness.eu
- in writing to the registered office (Fit - B, s.r.o., E. M. Šoltésovej 3109/1, 052 01 Spišská Nová Ves, Slovak Republic) or in person at the premises: Fit - B, s.r.o., Tehelná 20, 052 01 Spišská Nová Ves, Slovak Republic
- or at another place or with another person of whom the Seller has duly informed the Consumer.
For faster processing, we recommend stating:
- your name and contact details,
- the order or invoice number,
- identification of the product complained about,
- a description of the defect and the circumstances of its occurrence,
- the requested remedy,
- photographs or video, if possible.
Photographs or video are very useful for diagnosing large fitness equipment, but they are not automatically a legal condition for accepting a complaint. The Seller promptly provides the Consumer with a written confirmation of the defect notification.
XXIII. Consumer's rights in the event of a defect
If the Seller is liable for the defect, the Consumer primarily has the right to have the defect remedied by repair or replacement. The Consumer may choose between repair and replacement, unless the chosen remedy is impossible or, compared with the other remedy, would cause the Seller disproportionate costs considering all the circumstances.
Before remedying the defect, the Seller informs the Consumer of the right to choose between repair and replacement and of the statutory extension of the liability period after the first repair.
XXIV. Time limit for remedying the defect
The Seller remedies the defect within a reasonable time, free of charge, at its own expense and without causing the Consumer significant inconvenience. The time communicated to the Consumer must generally not exceed 30 days from the day the defect was notified.
A longer period is possible only if justified by an objective reason beyond the Seller's control. The burden of proving such a reason lies with the Seller.
XXV. Complaints regarding large and installed machines
For the purposes of repair or replacement, the Consumer hands the item over to the Seller or makes it available. The costs of taking over the defective item are borne by the Seller.
The Seller may, by agreement with the Consumer, arrange remote diagnostics, a service technician or another suitable way of assessing and remedying the defect. However, such an arrangement must not deprive the Consumer of their statutory right to choose the remedy provided by law.
If the repair or replacement requires the removal of an item that was properly installed before the defect became apparent, the Seller arranges its removal and the reinstallation of the repaired or replacement item; alternatively, the parties may agree that the Consumer arranges this at the Seller's expense and risk.
XXVI. Price reduction or withdrawal due to a defect
Under the conditions laid down by law, the Consumer has the right to a proportionate price reduction or to withdraw from the contract, in particular where:
- the Seller has failed to repair or replace the item properly,
- the Seller has refused to remedy the defect,
- the same defect appears despite repair or replacement,
- the defect is so serious that it justifies an immediate price reduction or withdrawal,
- the Seller has declared, or it is clear from the circumstances, that the defect will not be remedied within a reasonable time or without significant inconvenience to the Consumer.
The Consumer may not withdraw from the contract if the defect is insignificant; the statutory rules on the burden of proof remain unaffected.
XXVII. Rejection of liability for a defect
If the Seller rejects its liability for a defect, it informs the Consumer in writing of the reasons for rejecting the complaint. If the Consumer subsequently proves the Seller's liability by means of an expert opinion or a professional statement issued by an authorised person, they may notify the defect again under the conditions laid down by law.
XXVIII. What is not considered a defect for which the Seller is liable
The Seller is not liable for damage arising in particular from:
- normal wear and tear corresponding to the nature and intensity of use,
- incorrect or unsuitable use,
- use contrary to the product's intended purpose,
- neglect of prescribed maintenance,
- mechanical damage occurring after delivery,
- unprofessional intervention or modification of the product, where there is a causal link between the intervention and the defect,
- incorrect assembly carried out by the Buyer or a third party, unless the incorrect assembly was caused by a deficiency in the instructions for which the Seller is responsible,
- the use of unsuitable accessories or spare parts, if this caused the defect,
- use in an environment or at an intensity for which the product was not intended according to the information provided before the purchase.
The Seller cannot use this provision to exclude liability for a defect for which it is liable by law.
XXIX. Statutory liability vs. voluntary guarantee
The Consumer's statutory liability rights arise directly from the law. If AMREP FITNESS, the manufacturer or another person additionally provides a consumer guarantee - for example an extended guarantee for a specific component - this is an additional commitment over and above the statutory rights.
The conditions of any voluntary guarantee will be stated with the product, in the guarantee statement or in another relevant document. A voluntary guarantee must not limit the Consumer's statutory rights.
XXX. Failure to collect repaired or replacement goods
If the Buyer fails to collect the repaired or replacement item even within the period provided by law, the Seller may proceed in the manner permitted by the applicable law. For example, the current rules allow the item to be sold under specified conditions if it is not collected for six months; for an item of higher value, the Buyer must be informed of the intended sale in advance and given a reasonable additional period.
Business purchases (B2B)
XXXI. Special conditions for Business Buyers
This section applies to a Buyer who concludes the contract within the scope of their business or professional activity.
1. Consumer rights
Provisions granting special protection to Consumers do not apply to a Business Buyer, unless the law or an individual agreement provides otherwise. In particular, a Business Buyer does not have the statutory consumer right to return goods within 14 days without giving a reason. Any voluntary acceptance of a B2B return is possible only by agreement with the Seller.
2. Defects in B2B purchases
Rights and obligations concerning defects in B2B transactions are governed mainly by the Slovak Commercial Code, these Terms and Conditions, any individual contract and any guarantee expressly provided by the Seller or the manufacturer. The Business Buyer must inspect the goods within a period appropriate to the nature of the item and notify the Seller of any defects found without undue delay in accordance with the applicable legislation.
3. Commercial rating
If the equipment is intended only for home or limited commercial use, use beyond the declared scope may, in a B2B order, be a reason why specific damage will not constitute a defect for which the Seller is liable.
4. Individual projects
For gym fit-outs, larger orders, design work, custom manufacturing, transport, assembly and turnkey projects, a separate price, schedule, deposit, delivery date, scope of assembly, handover conditions, service conditions, guarantee and other specific rights and obligations may be agreed. An individual contract or a confirmed quotation prevails over these Terms and Conditions.
Account, communication and personal data
XXXII. Customer account
If the online store allows registration, the Buyer may create a customer account. The Buyer must provide true information and protect their login credentials against misuse.
The Seller may reasonably restrict or cancel the account, in particular in the event of fraudulent conduct, misuse of the service or serious violation of legal regulations or these Terms. Cancellation of the account does not affect rights and obligations arising from contracts already concluded.
XXXIII. Electronic communication
The Buyer agrees that routine communication concerning orders may take place electronically at the e-mail address they provided. This does not affect legal requirements for documents that must be delivered on a durable medium or in another specific manner.
XXXIV. Personal data protection
The processing of personal data is governed by the separate document AMREP FITNESS Privacy Policy published on the website. The rules for the use of cookies are regulated separately. Marketing consent is not a condition of making a normal purchase.
Dispute resolution and supervision
XXXV. Alternative dispute resolution for consumer disputes
The Consumer has the right to contact the Seller with a request for redress if they are not satisfied with the way their complaint was handled or if they believe the Seller has violated their rights. The request may be sent to info@amrepfitness.eu.
If the Seller rejects the request or fails to respond within 30 days of its dispatch, the Consumer may, under the conditions of Slovak Act No. 391/2015 Coll., submit a petition to initiate alternative dispute resolution with the competent ADR entity.
One of the competent entities is:
Slovak Trade Inspection (Slovenská obchodná inšpekcia)
Central Inspectorate
Department for International Relations and Alternative Resolution of Consumer Disputes
Bajkalská 21/A, 827 99 Bratislava 27, Slovak Republic
E-mail: ars@soi.sk or adr@soi.sk
Information on the competent alternative dispute resolution entities is available in the list published by the Ministry of Economy of the Slovak Republic. The Consumer may choose which competent entity to submit the petition to.
A Consumer with habitual residence in another EU country may also seek free assistance with a cross-border dispute from the European Consumer Centre (ECC-Net) in their country of residence, and may have access to alternative dispute resolution entities in that country under the rules applicable there.
XXXVI. Supervisory authority
The competent supervisory authority, within the scope of its statutory powers, is in particular:
Inspectorate of the Slovak Trade Inspection for the Košice Region
Vrátna 3, P. O. BOX A-35, 040 65 Košice 1, Slovak Republic
The Slovak Trade Inspection publishes its current contact details on its website. Consumer protection authorities in the EU cooperate on cross-border matters within the CPC network, and the Consumer may also contact the competent consumer protection authority in their own country.
Final provisions
XXXVII. Extraordinary circumstances
If performance is temporarily prevented or substantially hindered by an extraordinary circumstance that the Seller could not reasonably foresee or influence - for example a serious natural event, a state of war or a large-scale failure of critical infrastructure - the Seller will inform the Buyer without delay and take reasonable measures.
This provision does not exclude the Consumer's right of withdrawal, refund of payments or other mandatory rights granted by law.
XXXVIII. Intellectual property
The content of the online store - in particular logos, trademarks, photographs, videos, texts, graphics, design and other protected elements - may be subject to intellectual property rights of the Seller or third parties. Their use beyond the scope permitted by law is possible only with the consent of the relevant rights holder.
XXXIX. Governing law
Legal relationships between the Seller and the Buyer are governed by the law of the Slovak Republic. If the Buyer is a Consumer with habitual residence in another member state of the European Union, the choice of Slovak law does not deprive them of the protection afforded by the mandatory provisions of the law of the country of their habitual residence (Article 6 of Regulation (EC) No 593/2008, Rome I).
B2B relationships are governed in particular by Slovak Act No. 513/1991 Coll., the Commercial Code, unless the agreement or legal regulations provide otherwise.
XL. Final provisions
Consumer relationships are governed in particular by Slovak Act No. 40/1964 Coll., the Civil Code, Act No. 108/2024 Coll. on Consumer Protection, Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes, Act No. 22/2004 Coll. on Electronic Commerce and other generally binding legal regulations. Commercial relationships with Business Buyers are governed, depending on the nature of the relationship, in particular by Act No. 513/1991 Coll., the Commercial Code.
The Seller may amend these Terms and Conditions for the future. Each contract is always governed by the version of the Terms valid and effective at the moment of its conclusion. The Seller retains the relevant version of the Terms so that the conditions applicable to a specific order can be determined.
If any provision becomes invalid or unenforceable, this does not affect the remaining provisions, unless the law provides otherwise. No provision of these Terms shall be interpreted in a way that would deprive the Consumer of, or limit, rights that cannot be waived under the law.
Annex: model withdrawal form
Annex No. 1 - Model withdrawal form
We send the form by e-mail together with the order confirmation, and you can also download it here at any time.
Use of the form is not obligatory - you can also withdraw by a simple e-mail to info@amrepfitness.eu or by letter to Fit - B, s.r.o., E. M. Šoltésovej 3109/1, 052 01 Spišská Nová Ves, Slovak Republic.
